CDPAANYS and Bond, Schoeneck and King Attorneys are coming to Western New York with an educational intensive seminar that is essential to your fiscal intermediary’s toolkit.
The Buffalo Best Practices in Running Your Fiscal Intermediary Intensive will be held on April 25, 2018 at the Millennium Hotel Buffalo in Cheektowaga, NY.
With FI Authorization, wage parity, increased scrutiny from the OMIG, DOL examinations based on the minimum wage, and more, it is more important than ever for FIs to comprehend every aspect of this complex program.
This session will help Fiscal Intermediaries understand:
- The Best Practices associated with the industry;
- New ways to effectively implement policies and procedures that comply with the law;
- How the programmatic philosophy of Dignity of Risk and consumer control can exist along with compliance;
- How to efficiently run your business to maximize return in difficult financial times;

Bryan O’Malley, Executive Director of The Consumer Directed Personal Assistance Association of New York State (CDPAANYS), and Hermes Fernandez Co-Chair of Bond, Schoeneck & King Health Law Practice, will lead this morning seminar on effectively and efficiently running your fiscal intermediary.
Capacity is limited and registration will be held on a first-come, first-serve basis. This event will take place in New York City, Long Island, Western New York and the Capital District.
CDPAANYS has been the sole organization in New York State to exclusively represent fiscal intermediaries in CDPA since the program’s very beginning, playing a role in the law’s passage, the development and implementation of the regulations governing the program, and all advisory documents related to CDPA. CDPAANYS has also played a critical role in the transition of CDPA to managed care, serving on the Department of Health’s Transition Committee, negotiating the standard Administrative Agreement between plans and fiscal intermediaries, and conducting training sessions with managed long term care plans on how they could successfully utilize CDPA for their members.
Hermes Fernandez has served as counsel to CDPAANYS since 2002 as well as providing technical assistance to numerous fiscal intermediaries regarding regulatory compliance, contract negotiations, consumer agreement development, and more. Mr. Fernandez has also represented fiscal intermediaries on labor issues and advised both new and seasoned fiscal intermediaries on implementation of both the Affordable Care Act and the Fair Labor Standards Act and the Domestic Worker Bill of Rights. During the Fair Labor Standards Act, Mr. Fernandez wrote an amicus brief on behalf of CDPAANYS on the impact of the overtime and travel rules on CDPA. The brief prompted a question from the bench during the appeal.
