[Cdpaanys] URGENT/TIME SENSITIVE - Request from Court

Attorneys for CDPAANYS member Caring Professional, as well as Bond,
Schoeneck, and King on behalf of CDPAANYS and NYAIL, were back in Federal
Court today in the Courtroom of Judge Block for an emergency conference
regarding the implementation of the Preliminary Injunction.

The Conference related to health plans and LDSS failure to authorize
consumers subject to the PI to return to their previous FI. The State tried
to contend that we are not parties to the suit and that we should not have
standing, but Judge Block recognized the importance of FIs in the process.

*We urgently need all members to provide us with the following information.*
Please note, we *DO NOT* need to provide the court with your agency name,
you can be identified as a "Member of CDPAANYS". According to BSK we need:

   - Are any plans or districts refusing to provide you with a new contract?
   - The names of plans and LDSS who are refusing to authorize consumers
   - The names of plans and LDSS who are making it difficult for consumers
   to receive an authorization (we have heard that some plans basically are
   sending consumers over only after they insist multiple times).
   - The ways in which those plans or districts are causing problems (not
   honoring consumer requests, needing to call PPL before they can issue auth,
   issuing auth with no guarantee of reimbursement, issuing auth and
   rescinding retroactively, other...)
   - How many authorizations have you received?
   - How many consumers have called you asking for you to serve as their FI
   again?
   - Any other information you feel may be useful.


Please provide this information as quickly as possible, but at the latest *by
2:00 pm* *tomorrow, Wednesday, April 22.* This will allow us to turn the
information around to the Court by our deadline. Using the subject line
"[NAME OF FI] RESPONSE TO COURT REQUEST" will help us as we gather and
track responses. Again, we will not use the name of your agency in
reporting problems. All FIs will be identified as "CDPAANYS members".
